1. Agreement to these terms
These Terms and Conditions apply to your use of this website and to the material lists, takeoffs and related pre-construction planning services provided by CONSTRUCTABID LLC ("CONSTRUCTABID", "we", "us"). By using this website, sending us a request, or using our services, you agree to these terms. If you do not agree, please do not use the website or our services. Our Privacy Policy explains how we handle your information.
2. What we provide
We prepare material lists, quantity takeoffs and pricing comparisons from the plans and project details you give us, using software that includes artificial intelligence. Our work helps you plan and budget a project. We are not your contractor, architect, engineer or supplier, and we do not sell building materials or perform construction.
3. Lists and prices are estimates
Every material list, quantity and price we provide is an estimate. Please keep the following in mind:
- Lists are based on the plans and information you provide. Plans can contain errors, omissions or outdated details, and we do not guarantee that a list is complete or free of mistakes.
- Waste allowances, item substitutions and similar choices are assumptions. Real projects, site conditions and local requirements may need different materials or quantities.
- Prices come from third-party sources and change often. Prices, stock and availability vary by store, location and date, and the price you pay may differ from the price shown to you.
- Results produced with the help of artificial intelligence can contain errors. Review every list carefully.
You are responsible for checking all quantities, specifications and prices, and for confirming them with your suppliers and design professionals, before you order materials, prepare a bid, sign a contract or start work.
4. No professional advice
Our lists and information are not engineering, architectural, legal, financial or contracting advice. They are not a bid, quote, contract or guarantee of any project cost or outcome, and they do not confirm that any design or material meets building codes, permit requirements or safety standards. Consult licensed professionals for those matters.
5. Your plans and information
You keep ownership of the plans and information you provide. You confirm that you have the right to share them with us and that doing so does not break any law or anyone else's rights. You give us permission to use them to provide our services to you. Please provide accurate and complete information, since our results depend on it.
6. Client portal
Access to our client portal is by invitation. Keep your login details private and tell us right away if you think someone else has used your account. The portal is provided through a third-party provider, whose own terms may also apply. We may suspend or end portal access if these terms are broken.
7. Fees
If a fee applies to our services, we will quote it and agree it with you in writing before work begins.
8. Third-party names, prices and services
Home Depot, Lowe's and other store or supplier names mentioned on this website or in your lists belong to their owners. CONSTRUCTABID is not affiliated with, sponsored by or endorsed by them. We are not responsible for third-party prices, product information, availability or websites, and your dealings with third parties are governed by their terms.
9. Our content
The website, its design, text, logo and the CONSTRUCTABID name belong to CONSTRUCTABID LLC. Once we deliver a material list to you, you may use it for your own project or business. You may not copy, resell, scrape or republish our website or its content, or use it to train artificial intelligence systems, without our written permission.
10. Acceptable use
Please do not use this website or our services to break the law, upload harmful files or malicious code, interfere with the site's security or operation, send spam, or pretend to be someone else.
11. No warranties
To the fullest extent the law allows, this website and our services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including any warranty of accuracy, completeness, fitness for a particular purpose or non-infringement.
12. Limits on our liability
To the fullest extent the law allows, CONSTRUCTABID LLC and its owners, members, employees and contractors are not liable for indirect, incidental, special or consequential damages, or for lost profits, lost bids, project delays, cost overruns, material shortages or surpluses, or rework, arising from your use of the website, our lists or our services.
To the fullest extent the law allows, our total liability for any claim relating to the website or our services is limited to the amount you paid us for the specific service the claim relates to during the 12 months before the claim arose, or $100 if you paid us nothing. Some places do not allow certain limits, so parts of this section may not apply to you. Nothing in these terms limits liability that cannot be limited by law.
13. Your responsibility for claims
You agree to cover claims, losses and reasonable costs brought against us by others that arise from your misuse of the website or our services, from information or plans you provided without the right to share them, or from your breach of these terms.
14. Ending use
You may stop using our website and services at any time. We may suspend or end your access at any time if we believe these terms have been broken or to protect the service. Sections that by their nature should continue, such as those about estimates, liability and disputes, continue after use ends.
15. Governing law and disputes
These terms are governed by the laws of the State of Idaho, without regard to its conflict-of-law rules. If you have a concern, please contact us first so we can try to resolve it in good faith. If we cannot, disputes will be brought in the state or federal courts located in Idaho, and you and we agree to those courts' authority. Nothing in this section takes away rights that you have under consumer protection laws of your home state that cannot be waived.
16. Changes to these terms
We may update these terms from time to time. The updated version will be posted on this page with a new date, and it applies from the date it is posted. Continuing to use the website or our services after a change means you accept the updated terms.
17. General
If any part of these terms is found unenforceable, the rest stays in effect. These terms, together with our Privacy Policy and anything we agree with you in writing, are the whole agreement between you and us about the website and our services.
